Terms of Use

These terms are an agreement between you and Fission Ventures Limited (Company No. 12259667, 2 Pinfold Lane, Somersham, United Kingdom) — “we”, “us” — covering the PushUp Challenge mobile app and this website. By using the app you accept them.

1. Who may use the app

You must be at least 13 years old (or older where your country requires) to use the app, and old enough to form a binding contract to purchase a subscription.

2. Accounts

You can use the app without an account. If you create one — by email code, Google or Apple — you're responsible for keeping access to that email or sign-in method secure, and for what happens under your account. Give us accurate information and keep it up to date.

3. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable licence to use the app for your own fitness tracking. The app, its design, its brand and its code belong to us or our licensors; these terms give you no rights in them beyond that licence.

The core app is free. An optional auto-renewing premium subscription unlocks the Trainer program and the ability to create leagues (joining a league is always free). If your subscription lapses, your Trainer progress is kept and resumes when you re-subscribe. For subscriptions:

If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement applies except where these terms are stricter. Apple is not responsible for the app or its content, and Apple and its subsidiaries are third-party beneficiaries of these terms with the right to enforce them against you.

6. Leagues and conduct

League names and display names are visible to other members. Keep them free of anything unlawful, hateful or abusive; don't use the app to harass anyone or to misrepresent your identity. We may remove content or suspend accounts that break these rules.

7. Health disclaimer

PushUp Challenge is a tracking and timing tool, not medical advice. The Trainer program offers general, non-personalised exercise progressions; it does not know your health, is not tailored to you, and is not a substitute for a qualified coach or medical professional. Exercise carries risk. Consult a physician before starting any fitness programme, especially if you have a medical condition, and stop immediately if you feel pain, dizziness or shortness of breath. You use the app, set your own targets and follow the Trainer's suggestions at your own risk.

8. The service, as is

We work hard to keep the app reliable, but it's provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows. We may change, suspend or discontinue features at any time.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential losses, lost data, or lost profits arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence. Our total liability to you is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You can stop using the app or delete your account at any time. We may suspend or terminate accounts that violate these terms. On termination your licence ends; clauses that by their nature survive (including 7–9 and 11) continue.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — though if you live elsewhere you keep any mandatory consumer protections of your home country.
